Subject: RE: Political Situation in Romania

Dear All,

Please read the list of the facts that we attached and make your own opinion. I defend the democracy in my country, not a party or a person. Changes in power are normal, but destruction of the rule of law is not.
This is why please collect your information from objective sources. I belive that defending democracy comes before defending a sister party whatever it does.

In addition to the facts we sent you (through our head of Delegation, Mr Stolojan), as we speak, in Romania a coup d´etat is taking place. This afternoon new breaches of law took place: the dismissal of the Ombudsman, the illegal dismissal of the president of the Senate contrary to the law and 4 Constitutional Court Decisions holding that only the political group which had proposed the president can require his/her dismissal; the same will happen probably happen within an hour at the Chamber of Deputees.

Judges of the Constiutional Court were criticized publicly and threaten, they complained to the Venice Commission. Judges and prosecutors who "dared" to investigate and convict politicians from all parties, including the one I belong have also been under permanent threat in the last 2 months (and it was me who ensured, as minister of justice, the independent and impartial investigations of high level corruption, as many of you know from 2005-2006).

Changes of laws by Emergency Ordinances are the rule, after Prime Minister Ponta subordinated to himself the Official Journal a few days ago, thus avoiding the parliamentary debates and eventual challenges before the Constitutional Court. Etc Etc.

This is not about parties and names, this is about rule of law and facts. This value should not be defetead because some of my coleagues from the parties which are doing all these in Bucharest are "group" coleagues.

I don.t know what tomorrow will bring but it is as in June 1990 when the miners came to Bucharest, for those of you who remember this.

Thank you,
Monica Macovei

Subject: Political Situation in Romania
Dear Colleagues,

With regret we see that our Romanian colleagues from EPP are trying to misinform you about the situation in our country. We find outrageous the indignity of our colleagues from EPP to assume the responsibility for their acts in front of Romanian voters and it the attempt to internationalize the internal political dispute is inappropriate.

After the local elections in Romania, held on 10th of June, the alliance USL - Social Liberal Union - won over 50% of the expressed votes in the election for the county councils and presidency, 64% of the votes for the mayor mandates, including Bucharest and the most important cities of the country, and 53% of the votes for local councils. The next ranked result were for the former ruling party, PD-L, which has received about 15% of the votes.

Unfortunately, our colleagues from PD-L can't accept the result of the local elections, the change of the government under the pression of the mass protests and the responsibility for a catastrophic balance left by their government. In the perspective of the parliamentary elections, scheduled this autumn, PD-L, the party of Mr Stolojan, refuse to assume the disastrous economic and social results of the years when they have led the country with obvious and known authoritarian abuses.

Now, the fundamental institutions of the State, especially those related to justice and secret services - which despite the Constitution and the laws have been transformed by President Traian Basescu and by the former right-wing government in control and coercion instruments in our society - try to intervene in a biased manner in the political battle. These institutions abdicate from their mission, forgetting their prime purpose and being used for the prevention of the democratic alternation in power. We are witnessing a political vendetta through selective justice and through serious violations of fundamental norms of democracy and rule of law in an EU member country.

Also, President Traian Basescu has proven time and again that he is incapable of cooperating to advance Romania’s interests. The president is only interested in fostering a climate of hate and mistrust and does not act for advancing Romania’s interests. He disregards the message that the citizens of Romania have sent him. The president has managed, with help from the judges he nominated to the Constitutional Court, to transform a semi-presidential republic into a presidential dictatorship.

Romania is facing a huge social problem. The austerity measures have led to a drastic increase of poverty and inequality. PDL is supporting the same hateful and divisive policies that have brought Romanians on the brink of underdevelopment and hardship. USL and the Victor Ponta's government is trying to show Romanian citizens there are still reasons for hoping that things can change and that a fairer and less corrupt society can truly be built.

Thank you.

Best regards,

Corina Cretu and Catalin Ivan,
on behalf of the S&D Romanian Delegation
